General Release
I understand that roadside assistance and vehicle handling may involve
risk of incidental damage, especially where prior damage, corrosion,
altered components, concealed defects, wheel lock issues, or other
vehicle conditions exist. By signing below, I authorize the requested
service and acknowledge the condition of the vehicle as presented. I hereby
release the technician and Ozark Roadside, LLC directly or indirectly of
all responsibility, both civil and criminal, in a court of law for any
damage that is not deemed negligent. I accept full responsibility should
any damage occur that is out of their control. Any damage claim pertaining
to this specific service that has been deemed neglectful by a court of law
or authorized arbitration center can be submitted directly to Ozark
Roadside, LLC. All other damage is the full responsibility of the customer.
Any claim without a ruling from a court/arbitration center stating the
damage was the result of neglect will be denied.
Lockout Section
I acknowledge that lockout service may involve use of entry tools and that
weather stripping, trim, glass, switches, interior handles, or locking systems
may already be worn, damaged, or fragile. I am authorizing the use of these
tools on my vehicle and understand the risks associated to using these tools
such as scratches on the B pillar, torn weatherstripping, sprung doors,
interior door scratches and anything else that could be associated to the
use of such tools to perform the job.
Tire Service Section
I acknowledge that lug nuts, wheel studs, wheels, wheel covers, TPMS components,
and related hardware may be rusted, swollen, seized, overtightened, cross-threaded,
damaged, or otherwise compromised prior to service. Due to these conditions,
removal of a wheel may require additional force or specialized tools and may
result in further damage to already compromised components including lug nuts,
studs, wheel covers, caps, or related hardware.
I understand that roadside tire service is intended only to temporarily return
the vehicle to a drivable condition so the vehicle may be moved to the nearest
qualified tire repair facility. Temporary spare tires are typically designed
for speeds not exceeding 50 mph and distances generally not exceeding
approximately 40 miles from the location of installation, depending on the
manufacturer specifications and the condition and age of the spare tire.
I acknowledge that spare tires deteriorate with age and that most temporary
spares have a service life of approximately 4–6 years. I accept that Ozark
Roadside, LLC and the technician cannot be responsible for the condition, age,
prior use, or failure of a spare tire or any customer-supplied equipment used
during the service.
If lug nuts or studs are broken, rounded, seized, cross-threaded, or otherwise
unable to be removed using standard methods, I authorize the technician to use
extractor tools or other necessary removal methods to remove the wheel and
install the spare tire so the vehicle can be safely returned to the roadway.
I understand that these procedures may cause additional damage to the affected
lug nuts, studs, or related components and I authorize the technician to perform
these procedures as necessary to complete the service.
I acknowledge that I have been informed of these risks and I authorize the
technician and Ozark Roadside, LLC to perform the tire service requested.
By approving extractor or removal methods, I authorize Ozark Roadside, LLC
and its technician to perform the work necessary to remove the affected wheel
and install the spare in order to get the vehicle back on the road. I
understand this may involve additional damage to already compromised lug nuts,
studs, wheel covers, caps, or related components, and I release Ozark
Roadside, LLC and the technician from liability for damages resulting from
the authorized removal procedures necessary to complete the service, except
where such damage is determined to be negligent by a court of law or
authorized arbitration center.
